Orange County Uber driver named Edward Caban released a now <a href=\"https:\/\/www.youtube.com\/watch?v=xtJVbsHIj9o\" target=\"_blank\" rel=\"noopener\">viral video on Youtube<\/a> that depicted a scary confrontation\u00a0between himself and his passenger, Benjamin Golden. \u00a0In a little less than a week, the video has garnered over 2 million views and\u00a0raised serious questions about driver safety.<\/p>\n<p>The video itself depicts a drunk Golden, unable to sit up straight or give directions to the driver, turn violent when Caban demands that he exit the vehicle. \u00a0The video was recorded by the driver\u2019s\u00a0dash cam and it ends with the intoxicated Golden being pepper sprayed by Caban.<\/p>\n<p>Golden was arrested at the scene and his charges were upgraded the day after to <a href=\"http:\/\/www.nbcnews.com\/news\/us-news\/fired-taco-bell-exec-benjamin-golden-sued-uber-driver-report-n456821\" target=\"_blank\" rel=\"noopener\">four misdemeanors<\/a> according to the Orange County DA\u2019s office. \u00a0He was also fired from his position as a Taco Bell executive and will likely have trouble finding work for the rest of his life.<\/p>\n<p>For Uber drivers across the country, the first couple minutes of this video were nothing out of the ordinary. \u00a0<a href=\"http:\/\/therideshareguy.com\/drunk-drugged-and-disorderly-how-to-handle-the-late-night-crowd\/\" target=\"_blank\" rel=\"noopener\">We\u2019ve all had passengers<\/a> who were too drunk to enter their destination or unable\u00a0to give accurate directions, but rarely have things turned violent.<\/p>\n<p>In fact, with over 1 million trips per day, most of the newsworthy incidents regarding Uber usually\u00a0have to do with passenger safety. \u00a0Recently, an Uber driver in India was sentenced to <a href=\"http:\/\/www.bbc.com\/news\/world-asia-india-34707254\" target=\"_blank\" rel=\"noopener\">life in prison<\/a> for raping a female passenger and there are countless other horror stories in which drivers are most often\u00a0the perpetrators. \u00a0But this is one of the first well publicized cases we\u2019ve seen\u00a0where the driver was actually the victim instead of the passenger.<\/p>\n<p><strong>Was It Just A Matter Of Time?<\/strong><\/p>\n<p>Drivers have been dealing with drunk passengers since Uber\u2019s early days\u00a0and it\u2019s common knowledge that the \u2018Party Hours\u2019, typically Friday and Saturday evenings, are when it\u2019s busiest but also when you get the highest number of intoxicated passengers.<\/p>\n<p>I like to tell drivers <a href=\"http:\/\/www.therideshareguy.com\" target=\"_blank\" rel=\"noopener\">on my site<\/a>, that a good beginner strategy is to just \u2018Follow The Alcohol\u2019 since even Uber promotes its\u00a0platform as the safer alternative to drinking and driving. \u00a0And it\u2019s no different on holiday weekends like Halloween when this incident occurred.<\/p>\n<p>Here\u2019s a chart that Uber sent to my driver account a few days before Halloween weekend.<\/p>\n<p><img loading=\"lazy\" src=\"http:\/\/blogs-images.forbes.com\/harrycampbell\/files\/2015\/11\/Uber-Peak-Demand-Halloween-Night-1200x788.png\" alt=\"Uber Peak Demand Halloween Night\" width=\"458\" height=\"306\" \/><\/p>\n<p>You can see from the chart above that demand is at its highest when people have had a full night of drinking and partying and are just about ready to start heading home. \u00a0Now, dealing with drunks isn\u2019t the sexiest part about being an Uber driver but it is usually when you\u2019ll make the most amount of money. \u00a0Uber\u2019s surge pricing encourages drivers to come out on the road during these times and that increased pay can make up for having to deal with these unruly passengers.<\/p>\n<p>But drivers have always had a lot of concerns in regards to driving during this time. \u00a0There are some drivers who flat out refuse to drive nights\u00a0and others do it begrudgingly.<\/p>\n<p><strong>Should Uber Do More?<\/strong><\/p>\n<p>Unfortunately for drivers, Uber has <a href=\"http:\/\/www.forbes.com\/www.forbes.com\/sites\/harrycampbell\/2015\/10\/07\/why-are-so-many-las-vegas-uber-drivers-lying-to-their-insurance-companies\/\" target=\"_blank\" rel=\"noopener\">a history<\/a> of providing the bare minimum when it comes to what\u2019s required by the law. \u00a0So whether we\u2019re talking <a href=\"http:\/\/therideshareguy.com\/rideshare-insurance-options-for-drivers\/\" target=\"_blank\" rel=\"noopener\">rideshare insurance<\/a>, background checks or safety issues, Uber has deferred a lot of the risk of driving and owning a business to its independent contractors.<\/p>\n<p>And this case is no different. \u00a0I\u2019ve spoken with <a href=\"https:\/\/www.facebook.com\/TheRideshareGuy\/posts\/454969401367604\" target=\"_blank\" rel=\"noopener\">hundreds of drivers<\/a> about this particular incident over the past few days and\u00a0this video has really struck a nerve with a lot of them because it\u2019s brought to light the real risks of being an Uber driver. \u00a0Uber is starting to look more than ever like a glorified taxi service with a fancy app and that can be problematic for a couple reasons.<\/p>\n<p><strong>Driving A Taxi Is Dangerous<\/strong><\/p>\n<p>There\u2019s a reason why driving a taxi consistently ranks on top ten list for the most dangerous jobs. \u00a0And if you couldn\u2019t tell from the plexiglass screen that sits in-between you and your taxi driver,\u00a0<a href=\"https:\/\/www.osha.gov\/pls\/oshaweb\/owadisp.show_document?p_table=NEWS_RELEASES&amp;p_id=528\" target=\"_blank\" rel=\"noopener\">a report from OSHA<\/a> released in the year 2000 found that taxi drivers are 60 times more likely than other workers to be murdered on the job.<\/p>\n<p>Additionally, the report provided several recommendations in order to make things safer for taxi drivers:<\/p>\n<ul>\n<li><strong>automatic vehicle location or global positioning systems (GPS) to locate drivers in distress;<\/strong><\/li>\n<li><strong>caller ID to help trace location of fares;<\/strong><\/li>\n<li><strong>first-aid kits in every car for use in emergencies;<\/strong><\/li>\n<li><strong>in-car surveillance cameras;<\/strong><\/li>\n<li><strong>partitions or shields;<\/strong><\/li>\n<li><strong>protocol with police \u2014 owners and police to track high-crime locations;<\/strong><\/li>\n<li><strong>radios to communicate in emergencies (e.g., with an \u201copen mike switch\u201d);<\/strong><\/li>\n<li><strong>safety training for drivers;<\/strong><\/li>\n<li><strong>silent alarms;<\/strong><\/li>\n<li><strong>use of credit\/debit cards (\u201ccashless\u201d fare systems) to discourage robberies.<\/strong><\/li>\n<\/ul>\n<p>Out of the ten recommendations pulled straight from the OSHA report, Uber provides only three of these features on their platform. \u00a0Everything that you see in bold is currently not in place for Uber drivers\u00a0and remember, this report was released in the year 2000, so it\u2019s not exactly breaking news.<\/p>\n<p>This driver in this incident was\u00a0actually pretty well prepared though with a dash cam and pepper spray. \u00a0Unfortunately, most Uber drivers haven\u2019t even considered this kind of stuff until now.<\/p>\n<p>In the days following the incident, I\u2019ve fielded hundreds of inquiries from drivers <a href=\"http:\/\/www.forbes.com\/therideshareguy.com\/4-reasons-why-drivers-need-a-dash-cam\/\" target=\"_blank\" rel=\"noopener\">about dash cams<\/a> and whether or not they should be carrying non-lethal weapons. \u00a0Nowhere in Uber\u2019s lackluster training material does it mention the word dash cam and here\u2019s the response I got from Uber\u2019s customer support team when asking if I, as a driver, could carry non-lethal weapons while I\u2019m driving.<\/p>\n<p><img loading=\"lazy\" src=\"http:\/\/blogs-images.forbes.com\/harrycampbell\/files\/2015\/11\/Screenshot-2015-11-04-16.48.31-1200x802.png\" alt=\"Are Uber Drivers Even Allowed To Carry Non-lethal Weapons?\" width=\"541\" height=\"371\" \/><\/p>\n<p>This e-mail is a microcosm of the training and support that Uber drivers get on the job. \u00a0Their questions are often met with frustrating responses and Uber\u00a0rarely provides any sort of real guidance or help. \u00a0It\u2019s one of the reasons that drivers turn to third party resources like <a href=\"http:\/\/www.therideshareguy.com\/\" target=\"_blank\" rel=\"noopener\">my own blog<\/a> to get help and real-life advice.<\/p>\n<p><strong>Safety Issues Are Real<\/strong><\/p>\n<p>When you think about Uber\u2019s slogan, \u201cEverybody\u2019s Private Driver\u201d, the image you conjure up in your head probably doesn\u2019t involve plexiglass screens, dash cams and pepper spray. \u00a0But maybe it should.<\/p>\n<p>Uber and competitors like Lyft were built on the idea that normal every day people could drive to make a little extra cash in their spare time. \u00a0Uber\u2019s public policy strategist, David Plouffe, recently <a href=\"https:\/\/www.washingtonpost.com\/news\/wonk\/wp\/2015\/11\/03\/in-new-push-uber-tries-to-position-itself-as-the-cure-for-americas-economic-ills\/\" target=\"_blank\" rel=\"noopener\">touted the fact<\/a> that of the 400,000 Uber drivers nationwide, more than 50% of them drive less than 10 hours per week, which would seem to corroborate that narrative.<\/p>\n<p>But as Uber has expanded beyond the tech savvy millennial demographic and eroded the taxi industry\u2019s market share, it\u2019s passenger base has started to encompass that very same group that makes driving a taxi so dangerous. \u00a0The fact that a majority of Uber drivers drive less than 10 hours per week is actually a really bad thing when it comes to safety since it means they are less adequately prepared to handle these types of situations.<\/p>\n<p>In the days after this event, I heard from many taxi drivers who told me, this Uber driver handled this situation very poorly. \u00a0And while there\u2019s obviously no excuse for the violence perpetrated by Golden, it\u2019s possible that this situation could have easily been prevented with any single one of the numerous recommendations from that 15 year old OSHA report.<\/p>\n<p>Even the most\u00a0basic of real-time support systems like an emergency phone line that Uber drivers can call would make things safer for drivers. \u00a0As it stands today, there\u2019s actually no way for Uber drivers to contact Uber in real-time while they\u2019re out driving. \u00a0They\u2019re asked to e-mail in about any problems they have with a specific passenger or ride, which seems almost ridiculous for a $50 billion company.<\/p>\n<p>Uber has reacted to this incident the way you\u2019d expect, releasing an official statement that said, \u201cWe\u2019ve been in contact with Mr. Caban and are thankful he is doing ok.
